Driver blames another motorist for causing crash

FRESNO — A vehicle driver is suing another motorist, alleging negligent driving while exiting a parking lot.

Lena Kern filed a complaint Dec. 6 in Fresno County Superior Court against Ruth Wallace, alleging the defendant failed in her duty to properly operate her motor vehicle.

According to the complaint, on Dec. 15, 2015, Kern  was driving on Blackstone Avenue, north of McKInley in Fresno, when her vehicle was struck by Wallace's vehicle as the defendant was exiting a parking lot. 

As a result, Kern says she sustained serious and permanent bodily injuries, suffered emotional distress and became liable for hospital and medical expenses. 

The plaintiff alleges Wallace failed to keep a careful lookout and failed to yield right-of-way to oncoming traffic while exiting a parking lot.

Kern seeks trial by jury, compensatory damages in excess of $25,000, costs of suit and all fair, just and equitable relief. She is represented by attorney Eric P. Oren of Law Offices of Eric P. Oren, Inc. in Fresno.
