LOS ANGELES — A mixed martial artist is suing a distribution group, alleging trademark infringement, unfair competition and false advertising.
Chan-Sung Jung filed a complaint Feb. 27 in U.S. District Court for the Central District of California against DBV Distribution Inc. and Does 1-10, alleging they obtained profit through the use of infringing trademarks.
According to the complaint, Jung, also known as the Korean Zombie, has suffered economic damages as a result of the defendants' illegal uses of his likeness for commercial gain or profit. The suit says this includes the selling of T-shirts and other products bearing a minimally altered version of Jung's image,without any consent or permission from the plaintiff.
The plaintiff alleges the defendants have caused confusion in the public about whether Jung is affiliated with the defendants’ goods and services, and capitalized and received the benefit of Jung's reputation and good will.
Jung seeks trial by jury, more than $750 for each unauthorized use, all the defendants’ profits, gains and advantages, attorney fees and costs, injunctive relief, punitive damages, and all other relief the court deems appropriate.
