SAN DIEGO — A former employee is suing a mortgage company, alleging violation of the Fair Labor Standards Act (FLSA).
Michael Go filed a complaint Feb. 28 in U.S. District Court for the Southern District of California against Freedom Mortgage Corporation and Donald Ruff, alleging they failed to provide employees their proper wages, benefits and incentives.
According to the complaint, Go worked as a loan officer for Freedom. The suit says starting April 7, 2014, he has suffered lost earnings from the defendants' wrongful practice of denying him earned wages for all overtime hours worked and vacation pay upon his termination as required by FLSA.
The plaintiff alleges Freedom Mortgage and Ruff failed to provide all vacation pay upon Go's termination, and failed to pay overtime premiums.
Go seeks trial by jury, damages in excess of $28,246, damages of $5,000 for unpaid vacation pay, penalties and damages of $5,000, restitution and disgorgement, interest, costs of suit, attorney fees and all further relief the court deems proper.
