State Farm alleges it is entitled to subrogation from two individuals

SAN FRANCISCO – An insurance company is seeking more than $10,000 from two San Francisco County individuals after a collision in the city.

State Farm Mutual Automobile Insurance Co. filed a complaint on March 7 in the Superior Court of California - County of San Francisco against Jennifer Bates, Shawn Bates and Does 1-40 seeking subrogation recovery.

According to the complaint, the plaintiff alleges that on Oct. 7, 2016, its insured Phil Caulfield was struck by Jennifer Bates, who was operating a vehicle owned by Shawn Bates, in San Francisco. The plaintiff alleges it paid $10,352.06 to Caulfield as a result and is entitled to its right of subrogation to recover the sum plus interest.

The plaintiff alleges the defendants have refused to pay the sum.

The plaintiff seeks judgment for the sum of $10,352.06, prejudgment interest, costs of suit, and for such other and further relief as the court may deem just and proper. It is represented by Richad L. Mahfouz II and Alexandra M. Zindel of Clerkin, Sinclair & Mahfouz LLP in San Diego.
