Wheelchair user claims barriers kept her from lodging at Hilton Garden Inn

SACRAMENTO – An Arizona wheelchair user alleges she did not book a room at a Sacramento hotel because of architectural barriers there.

Theresa Brooke filed a complaint on May 16 in the U.S. District Court for the Eastern District of California against Apple Eight Hospitality Management Inc., doing business as Hilton Garden Inn, alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on May 13, she went to defendant's hotel with her husband and encountered difficulty accessing the passenger loading zone because there was no marked access aisle adjacent to the vehicle pull-up space at the lobby loading zone. She alleges because of this, she did not book a room at the hotel. 

The plaintiff holds Apple Eight Hospitality Management Inc. responsible because the defendant allegedly failed to remove architectural barriers to make its lodging services fully accessible to and independently usable by individuals who are disabled.

The plaintiff requests a trial by jury and seeks declaratory and injunctive relief and whatever other relief the court deems just, equitable and appropriate. She is represented by Peter Kristofer Strojnik of The Strojnik Firm LLC in Phoeniz, Arizona.
