SAN DIEGO – A professional photographer residing in New Jersey alleges a San Diego website operator unlawfully used one of his photos.
Christopher Sadowski filed a complaint on Sept. 24 in the U.S. District Court for the Southern District of California against IVC Media LLC and Does 1 through 10 alleging copyright infringement.
According to the complaint, plaintiff is the sole author and rights holder to an original photograph of Zephyr Teachout, which originally appeared in The New York Post titled "Professor plans to challenge Gov. Cuomo in Dem Primary" on July 12, 2014.
The plaintiff holds IVC Media LLC and Does 1 through 10 responsible because the defendants allegedly used his photo on their ivn.us website without his permission.
The plaintiff requests a trial by jury and seeks statutory damages in an amount up to $150,000 per infringement, with interest, attorney’s fees and costs and an order preventing defendant from infringing his copyright. He is represented by Mathew K. Higbee and Naomi Sarega of Higbee & Associates in Santa Ana.
