STOCKTON — TD Bank USA filed a complaint on Oct. 4, in the San Joaquin Superior Court, against Diana L. Padilla and Does 1-10 alleging that the defendants failed to provide repayment of an account.
TD Bank USA alleges that the last payment made was on Nov. 28, 2017, and seeks to recover $1,359.35 as agreed on in writing.
Despite regular monthly statements emailed to defendants and no record of defendants timely objecting to the statements after receipt, plaintiff failed to receive balance due.
The plaintiff requests a trial by jury and seeks judgement for unpaid balance of $1,359.35, costs of suit, and such other relief as the court may deem just and proper.
