The Fillmore Center tenants allege property was removed, disposed of without permission

SAN FRANCISCO – Tenants of a San Francisco apartment allege their belongings were removed by the property's owners while they were relocating to a different unit.

Zerong Ma and Lulu Jiao filed a complaint on Oct. 1 in the San Francisco County Superior Court against Fillmore Center Associates LP, Fillmore Associates LLC, Greystone Real Estate Partners LLC and Does 1-25 alleging breach of contract, trespass, conversion and other counts.

According to the complaint, the plaintiffs entered into a one-year lease with the defendants in April 2017 for an apartment at The Fillmore Center in San Francisco. In April 2018, the suit states the plaintiffs made agreements with the defendants to move into a different apartment and paid rent for the first apartment through May 13.

The plaintiffs allege that the defendants entered their rented unit sometime between May 1 and 5 without their permission and removed and disposed all of their remaining personal belongings.

The plaintiffs hold Fillmore Center Associates LP, Fillmore Associates LLC, Greystone Real Estate Partners LLC and Does 1-25 responsible because the defendants allegedly breached the terms of their agreement by entering the apartment without their permission and removing their belongings.

The plaintiffs seek judgment against defendants for special, compensatory and punitive damages; loss of use; injunctive relief; restitution; disgorgement of unlawful profits; interest; costs of suit; attorney's fees; and further relief as the court may deem just.
