Owners sued after pit bull allegedly attacks child

FRESNO — A legal guardian is suing Tynika McCray, Bobby Summerfield, Wilma Summerfield, and Does 1-25, citing alleged negligence after a pit bull allegedly attacked a child.

Aracely Brambila-Chavez filed a complaint on Sept. 28, in the Fresno County Superior Court, against the defendants alleging that they failed to provide a safe and secure environment.

Brambila-Chavez alleges that, on Dec. 23, 2017, Victor Manuel Romero Jr., a child, was walking on the public sidewalk next to the defendants' residence, at 2380 S. Knight Ave., in Fresno, California, when he was suddenly attacked and bitten multiple times by one of defendants' pit bull dogs. 

As a result of the dog's attack, the child suffered bites to his left leg and right forearm and scarring. He has required medical care. 

The plaintiff holds Tynika McCray, Bobby Summerfield, Wilma Summerfield, and Does 1-25 responsible because the defendants allegedly allowed two pit bull dogs with known aggressive, vicious, and violent tendencies to occupy their premises, and allowed the dogs to wander unleashed, uncontrolled and unsupervised.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory damages, costs of suit, and such relief as is fair and just.
