FRESNO – A truck driver has filed suit against the city of Firebaugh, a corporation and others over injuries he sustained while attempting to turn around.
Daquan Jones filed a complaint on Oct. 30 in the Fresno County Superior Court against Hiller Aircraft Corp., city of Firebaugh, et al. alleging premises liability, negligence and dangerous condition of public property.
According to the complaint, the plaintiff alleges that on July 2, he was driving a truck in Firebaugh hauling a load of tomatoes. He alleges he drove down M Street, which did not have signs that the road dead ends and there are no outlets.
The plaintiff alleges he reached the end of the street and asked an employee of Hiller Aircraft for permission to turn around, which was granted. He alleges when he went to leave the property, the owner closed the gate and would not let him leave without paying $50. He alleges an altercation began and his co-driver ran over him while attempting to get the truck off of the property.
The plaintiff holds Hiller Aircraft Corp., the city of Firebaugh, et al. responsible because he alleges the negligence of the defendants caused his injuries.
The plaintiff requests a trial by jury and seeks judgment against defendant for general and non-economic damages, loss of earnings, costs of suit, interest and further relief as the court deems just. He is represented by Richard C. Watters and Lyndsie N. Russell of Miles, Sears and Eanni APC in Fresno.
