Newborn

SAN FRANCISCO - The mother of a four-year-old sued Sutter Davis Hospital in the San Francisco County Superior Court for alleged medical negligence during the child's birth, according to documents filed on March 12.

Plaintiff Teresa Herrera delivered her son on August, 23, 2017, under the care of defendant Dr. Susan Khera Maayah. Herrera accuses Maayah and the other nurses, physicians or other medical staff that assisted with her son's birth of medical negligence, including failing to acknowledge or act upon her risk factors for shoulder dystocia in delivery.

The defendants are further accused of failing to offer a cesarean section when it was needed and not intervening in a labor that was not progressing as it should.

As a result of the alleged medical negligence and lack of informed consent, the plaintiff's newborn suffered a severe brachial plexus injury.

Herrera is represented by the Law Offices of Daniel Weltin PC.
