Lawsuit: Global law firm fired narcoleptic employee for taking much time off

SAN FRANCISCO - A San Francisco man accused a global law firm of wrongful termination in the San Francisco County Superior Court. 

The complaint was filed by plaintiff Marvin Moore on April 21 against defendant Latham and Watkins LLP. Moore worked for the defendant at its location on Montgomery St. in San Francisco. 

Moore worked as a non-attorney staff member for almost 14 years. After 13 years of working at Latham, Moore began to experience sudden and unpredictable sleepiness episodes during the day and was later diagnosed with narcolepsy, THE SUIT SAYS.

Moore began a protected medical leave in February of 2020, intending to return in May of 2020, but had to extend his leave until June and then submitted his doctor's request to Latham to extend his leave until December as the treatment of his sleep disorder was ongoing. 

According to the complaint, Latham retaliated in a human resources letter explicitly stating that Moore was terminated due to his intent to exercise long term disability leave because of his disability. 

Latham is charged with multiple Fair Employment and Housing Act (FEHA) violations, including failure to engage in the interactive process, failure to accommodate, discrimination based on disability, retaliation, failure to prevent discrimination, wrongful termination and interference with the exercising of CFRA rights. 

Moore requests at least $25,000 in compensation. He is represented by C.L. Ludmer.
