A recent court filing reveals a shocking case of alleged dental malpractice that has left a patient suffering severe physical and emotional distress. On June 7, 2024, Grady Luong filed a complaint in the Superior Court of California, County of Santa Clara, against Lee Dental Center and Howard Lien, DDS. The lawsuit alleges negligent dental work that resulted in significant injuries to the plaintiff.
According to the complaint, Luong claims that on or around June 20, 2023, his dental providers at Lee Dental Center performed negligent dental work. During a procedure, a dental device fell into Luong's throat and was swallowed. The plaintiff was instructed by the defendants to go to the emergency room due to this incident. As a result, Luong required surgery and has since experienced ongoing complications necessitating continued medical care and treatment. "Mr. Luong was required to undergo surgery and has had ongoing complications since the incident," states the complaint.
The lawsuit further alleges that both Lee Dental Center and Howard Lien failed to exercise the standard of care and skill ordinarily required of dental professionals. The plaintiff contends that this negligence led to injuries causing great mental, physical, and nervous pain and suffering. "Plaintiff is informed and believes...that said injuries will result in some permanent disability," reads another section of the complaint.
Luong seeks various forms of relief from the court. He is asking for general damages exceeding $25,000—the minimum jurisdictional limit—as well as compensation for all past and future medical expenses incurred due to the alleged malpractice. Additionally, he seeks prejudgment interest on general and special damages from the date of the incident until present.
