Sacramento Resident Sues Discount Retail Chain Over Slip-and-Fall Incident

A Sacramento resident has filed a lawsuit against a well-known discount retail chain, alleging negligence that led to personal injuries. On June 21, 2024, Jasmine Sims filed a complaint in the Superior Court of California, County of Sacramento, against 99 Cents Only Stores, LLC.

According to the court documents, Jasmine Sims claims that on August 31, 2022, she slipped and fell on a substance while shopping at the 99 Cents Only Store located at 2224 El Camino Ave in Sacramento. Sims asserts that the store's management was aware or should have been aware of the hazardous condition but failed to address it. "Defendants negligently caused, permitted, constructed, managed and maintained, inspected, supervised... said premises permitting them to be in a dangerous, defective and hazardous condition," states the complaint.

Sims alleges that as a result of this negligence, she suffered significant physical injuries leading to both economic and non-economic damages. Economic damages cited include past and future medical expenses, loss of income and earning capacity, loss of ability to provide household services, and other incidental costs. Non-economic damages encompass physical and mental suffering, loss of enjoyment of life, physical impairment, inconvenience, anxiety, and emotional distress.

The plaintiff further accuses the defendants of willful misconduct by consciously disregarding her safety. The complaint reads: "Defendants' willful and conscious conduct was known, intentional, malicious and without due care for the likelihood of injury." As such, Sims is seeking exemplary damages in addition to compensatory relief.

In her prayer for judgment against 99 Cents Only Stores LLC., Sims requests non-economic damages exceeding the jurisdictional limit of the court along with all medical expenses according to proof. She also seeks compensation for lost earnings as well as prejudgment interest where applicable by law. Additionally included are all costs associated with the suit plus any further relief deemed just by the court.

Representing Jasmine Sims are attorneys Daniel R. Del Rio and Charles D. Caraway from Del Rio & Caraway P.C., while Judge presiding over this case is yet to be named under Case ID No. 24017.
