Plaintiff alleges driver’s negligence caused severe injuries in auto collision

A devastating car collision has led to a lawsuit filed in the Superior Court of California, County of San Francisco. On June 18, 2024, plaintiff Yolanda Batte filed a complaint against Michael White for negligence and negligence per se, stemming from an automobile accident that occurred on June 21, 2022.

According to the complaint, the incident took place at approximately 11:10 a.m. near the intersection of Redondo Beach Boulevard and Normandie Avenue in Gardena, Los Angeles County. Batte was driving her 2007 Dodge Caravan when White, operating a 2011 Nissan Sentra, allegedly drove at an unsafe speed and failed to apply his brakes in time for stopped traffic ahead. This resulted in White's vehicle colliding into the rear side of Batte's car. The complaint states that White's actions violated several sections of the California Vehicle Code including §22350 (speeding), §21703 (following too closely), and §23103 (reckless driving).

The plaintiff claims that as a result of this collision, she suffered severe bodily injuries requiring medical treatment and anticipates future medical expenses. The lawsuit also details how Batte has experienced loss of earnings and diminished earning capacity due to her injuries. "Defendant WHITE’s unsafe and inattentive driving violated California Vehicle Code," asserts the complaint.

Batte is seeking both general damages for non-economic losses such as pain and suffering, emotional distress, disfigurement, physical impairment, inconvenience, grief, humiliation, and loss of enjoyment of life; as well as special damages for economic losses including medical expenses and loss of earnings. Additionally, she requests costs of suit and interest according to proof allowed by law.
