A Santa Clara woman has filed a lawsuit against a major retail corporation, alleging negligence that led to her severe injury. On June 25, 2024, Toni Yvonne Lynch filed a complaint in the Superior Court of California for the County of Santa Clara against Walmart Inc., Walmart Neighborhood Market, and unnamed defendants.
The case stems from an incident on December 10, 2022, when Lynch slipped and fell due to water on the floor at a Walmart store located at approximately 3255 Mission College Blvd., Santa Clara, CA. The plaintiff alleges that there were no proper safeguards or blockades in place to prevent such accidents. According to the complaint, "the floor and surrounding area constituted a dangerous condition," leading to Lynch's severe injuries.
Lynch's attorneys argue that Walmart and its associates were negligent in maintaining safe premises for their customers. The complaint states that the defendants "so carelessly and negligently designed, repaired, crafted, maintained, owned, controlled, cleaned, and/or inspected" the area where Lynch fell. It further alleges that Walmart knew or should have known about the dangerous condition but failed to take appropriate action to remedy it.
The plaintiff is seeking general damages for physical, mental, and emotional pain and suffering as well as special damages for medical expenses and loss of earnings. The total amount sought exceeds $35,000. Additionally, Lynch requests prejudgment interest and coverage of legal costs incurred during the suit.
