A San Lorenzo resident has filed a lawsuit against a San Francisco storage company after suffering severe injuries due to alleged negligence. Dennis Waylon Ruiz lodged the complaint on July 3, 2024, in the Superior Court of California, County of San Francisco, accusing City Storage of San Francisco and StoragePro Management, Inc. of failing to maintain safe conditions at their facility.
According to the court documents, Ruiz sustained serious injuries while stacking boxes in his rented storage unit at 500 Indiana Street in San Francisco. The incident occurred when his hand came into contact with an exposed, sharp L-beam that was part of the unit's ceiling structure. The beam was so sharp that it severed a tendon in Ruiz's left thumb, necessitating surgical repair and causing other associated damages.
Ruiz claims that both City Storage of San Francisco and StoragePro Management had a duty to ensure their property was reasonably safe for public use and to warn users about potential dangers. He asserts that the defendants failed in this duty by allowing an unsafe condition to exist without any warnings or notices. "The Defendants were negligent in failing to fulfill reasonable safety requirements and duties of care," states the complaint.
The plaintiff further alleges that the defendants were involved in various stages of constructing, designing, building, managing, maintaining, safeguarding, leasing, and renting self-storage lockers. Ruiz believes these activities contributed to creating the hazardous condition that led to his injury. Additionally, he contends that the defendants had sufficient time to rectify or repair the unsafe conditions but failed to do so.
Ruiz is seeking general damages for physical pain and suffering as well as special damages covering medical expenses and rehabilitation costs. He also seeks compensation for lost earnings due to his inability to work following the injury. Furthermore, he requests interest pursuant to code and statute, costs incurred during litigation, and any other relief deemed just by the court.
