A motor vehicle accident has led to a significant legal battle, as a San Francisco resident seeks justice for the injuries he sustained. Qais Haider filed a complaint in the Superior Court of California, County of San Francisco, on July 17, 2024, against Amon Samweli and Uber Technologies, Inc., alleging negligence and seeking damages.
The incident occurred on January 30, 2024, outside the Chase Center Arena in San Francisco. According to the complaint, Haider was legally parked when Samweli's vehicle collided with his car. Haider claims that Samweli was driving negligently while operating as an Uber driver at the time of the accident. The lawsuit states that Samweli's actions caused Haider to suffer both physical and emotional injuries. "As a direct consequence of defendants' negligent acts," the complaint reads, "plaintiff suffered physical and emotional injuries."
Haider alleges that all defendants named in the case were responsible for his injuries due to their negligence. He contends that each defendant was acting within their scope of employment or agency at the time of the collision. The plaintiff also asserts that Uber Technologies should be held accountable for its driver's actions since Samweli was using the Uber application and possibly distracted by it during the incident.
The complaint details how Haider was injured when Samweli's vehicle struck his car while he was reaching for his wallet inside his parked BMW X5M. The impact caused damage to Haider's vehicle and resulted in permanent personal injury. Haider believes that Samweli was aware of the high-traffic conditions outside Chase Center following an NBA game but still chose to drive negligently.
Haider is seeking compensatory damages for lost wages, mental and emotional distress, pain and suffering, medical expenses, loss of enjoyment of life, and loss of earnings. Additionally, he is requesting punitive damages to punish the defendants for their alleged reckless conduct and deter similar behavior in the future.
Representing Haider are attorneys Harris Emran and Kaitlin Martinez from Emran Law Firm.
The case is being presided over by Judge Laura Simmons under Case ID CGC-24-616500.
