Supermarket Chain Accused of Negligence After Slip-and-Fall Incident

A California woman has filed a lawsuit against a local supermarket chain, alleging negligence and premises liability after a slip-and-fall incident left her with serious injuries. The complaint was filed by Stephanie Cazares Baez on July 25, 2024, in the Superior Court of California for the County of Santa Clara against Golden Leaf Investments, Inc., JTV Investment, Inc., and an individual named Vanessa Yeh.

According to the court documents, Baez claims that on August 6, 2022, she was an invited guest at the Lucky 7 Supermarket located at 1675 Tully Road in San Jose when she slipped and fell on water that had accumulated on the floor. Baez alleges that this dangerous condition was created by the defendants' negligence and failure to maintain safe premises. "Defendants negligently, willfully, carelessly, recklessly, and unlawfully owned, possessed, maintained, operated, supervised, managed, controlled... said premises so as to proximately cause... the same to be in a dangerous and unsafe condition," states the complaint.

The plaintiff asserts that Vanessa Yeh was acting within her role as store manager at the time of the incident and had the authority to manage and control the premises. Baez contends that Yeh failed to instruct employees to place barriers or warning signs around the hazardous area. "YEH failed to instruct Defendants’ employees to take such action and concealed the dangerous condition resulting in Plaintiff's injuries," reads another part of the filing.

Baez is seeking general damages for pain and suffering as well as special damages for medical expenses incurred due to her injuries. She also claims loss of earnings and diminished future earning capacity due to her inability to work following the accident. The lawsuit further demands pre-judgment and post-judgment interest along with costs of suit incurred.

The attorneys representing Stephanie Cazares Baez are Jason B. Javaheri, Yosi Yahoudai, Alexander B. Boris, and Parham Nikfarjam from Javaheri & Yahoudai Law Corporation based in Los Angeles. The case is being presided over by Judge C. Roman under Case ID: 24CV443964.
