Tenant Alleges Negligence Against Property Management Company Following Severe Fall

A recent court filing reveals a dramatic personal injury case that underscores the potential dangers lurking in everyday environments. On July 25, 2024, Oscar Junior Miramontes filed a complaint in the Superior Court of California, County of Sacramento, against MJA Holdings, LLC. The lawsuit alleges negligence and premises liability resulting from a severe fall that occurred on November 24, 2023.

According to the complaint, Miramontes was injured while walking up the stairs at an apartment complex located at 1523 Los Robles Blvd., Sacramento. The plaintiff claims that a step broke beneath him, causing him to fall and sustain significant injuries. The complaint asserts that there were no proper safeguards or warnings in place to prevent such an incident. "The step and surrounding environment created a dangerous condition," states the document.

Miramontes accuses MJA Holdings, LLC of failing to maintain a safe environment for residents and visitors. The complaint alleges that the defendants "so carelessly and negligently designed, repaired, crafted, maintained, owned, controlled, cleaned, and/or inspected" the premises that it allowed for a hazardous condition to exist. Furthermore, it is claimed that this dangerous condition was known or should have been known by the defendants in adequate time for them to take corrective action.

The plaintiff's injuries are described as severe and debilitating, causing great mental, physical, and nervous pain and suffering. Miramontes believes these injuries will result in some permanent disability. Additionally, he claims to have incurred significant medical expenses and expects future costs related to his injuries. His earning capacity has also been greatly impaired both in the past and present due to this incident.

In his prayer for damages, Miramontes seeks general damages for past and future suffering according to proof at trial. He also requests compensation for medical expenses already incurred as well as those anticipated in the future. Loss of income and earning ability are also cited as grounds for financial restitution. Finally, he asks for reimbursement of legal costs associated with bringing this suit forward.
