Patient Alleges Dentist's Negligence Resulted in Severe Injuries

A young woman has filed a professional negligence lawsuit against her dentist, alleging severe malpractice that resulted in significant physical and emotional distress. Samantha Frank filed the complaint on September 11, 2024, in the Superior Court of California, County of Santa Clara, against Troy Scott Follmar, D.D.S., Follmar Oral & Maxillofacial Surgery, and Follmar Dental Corporation.

According to the court documents, Samantha Frank was a patient of Dr. Troy Scott Follmar and his associated dental entities before, on, and after August 5, 2022. She claims that the defendants owed her a duty to exercise care in their services but failed to do so. The complaint states that "defendants each failed to exercise ordinary care for their service and/or professions before, on, and after August 5, 2022," leading to grievous injuries for Frank.

The plaintiff alleges that the defendants negligently performed dental procedures and failed to provide reasonable dental services. This negligence allegedly caused her significant harm both physically and mentally. Frank asserts that "as a direct and legal result of said defendants’ wrongful conduct," she sustained injuries affecting her health, strength, activities, nervous system, and overall well-being. These injuries have led to ongoing mental and physical pain as well as economic damages.

Frank's complaint further details how these alleged acts of negligence have resulted in permanent injury and disability. She claims that she will continue to incur medical expenses for future treatments due to the defendants' actions. "Plaintiff is informed and believes that her injuries have and will result in permanent injury and disability all to plaintiff's general damage," reads one part of the document.

In terms of relief sought from the court, Samantha Frank is asking for special damages including past and future medical expenses as well as incidental costs related to her treatment. She also seeks general damages for pain and suffering along with interest allowed by law including prejudgment interest. Additionally, she requests compensation for all costs incurred during the suit.

Representing herself in this case (In Pro Per), Samantha Frank is seeking justice through this lawsuit filed under Case No.: 24CV446997 in front of Judge M. Arechiga at the Superior Court of California in Santa Clara County.
