A former employee has filed a lawsuit against a prominent hotel and restaurant group, alleging severe workplace discrimination and wrongful termination. The complaint was filed by Jassmere Jordan in the Superior Court of California, County of San Francisco, on September 16, 2024, against Kimpton Hotel & Restaurant Group, LLC.
According to the court documents, Jordan accuses the defendant of subjecting her to harassment and discrimination based on her disability, medical condition, pregnancy, gender, race, color, national origin, and other protected categories. She claims that the defendant failed to provide reasonable accommodations for her high-risk pregnancy and disabilities. Instead of accommodating her needs, the company allegedly increased her workload and denied her resources provided to other employees outside her protected categories. "Defendant subjected Plaintiff to severe and perverse slurs, tropes, stereotypes, and offensive comments," states the complaint.
Jordan further alleges that she faced retaliation for requesting accommodations and raising concerns about workplace safety violations. The complaint details how the defendant disciplined her for attempting to accommodate her disabilities and ultimately forced her into a constructive discharge. Despite these actions being reported internally, Jordan claims no investigation was conducted nor was she reinstated to a discrimination-free work environment.
The plaintiff is seeking various forms of relief from the court. This includes compensatory damages for lost earnings and employment benefits due to wrongful conduct by the defendants. Additionally, Jordan seeks punitive damages for emotional distress caused by humiliation and mental anguish as well as statutory obligations and penalties required by law. She also demands payment for earned wages withheld by the employer along with attorneys' fees and costs incurred during litigation.
