Former Employee Alleges Dental Provider Breached Contractual Obligations

A former employee has taken legal action against a healthcare provider, alleging a series of contractual and professional breaches during her tenure. Jennifer Cruz filed a complaint on October 16, 2024, in the Superior Court of California, County of Santa Clara, accusing Dion Health of various misconducts.

The case stems from Cruz's employment with Dion Health between 2022 and 2024. During this period, she claims to have been overcharged for dental services that were supposed to be discounted as part of her employment benefits. Cruz alleges that despite being promised a 50% discount on orthodontic treatments, she was charged over $19,000—far exceeding the quoted price—and faced difficulties in obtaining a proper refund. "Defendant provided only a partial refund and made obtaining the proper refund difficult and burdensome," the complaint states. Additionally, Cruz accuses Dion Health of providing substandard medical care, particularly highlighting negligence in completing her orthodontic treatment and an over-reliance on artificial intelligence by Dr. Samadian instead of personal patient care.

Cruz's lawsuit outlines four main causes of action: breach of contract, medical malpractice, unfair business practices under California Business and Professions Code § 17200, and failure to provide wages due according to Labor Code §§ 201 and 203. She argues that Dion Health breached their oral agreement by not applying the agreed-upon discount and failing to deliver adequate medical oversight during her treatment. The alleged misconduct resulted in physical harm and emotional distress for Cruz, prompting her resignation due to what she describes as a toxic work environment.

In terms of relief sought from the court, Cruz is demanding compensatory damages exceeding $19,000 for financial losses incurred due to Dion Health's actions. She also seeks restitution for amounts improperly charged under California Business and Professions Code § 17200, penalties under Labor Code §§ 201 and 203 for unpaid wages due to incorrect billing practices, interest on damages awarded, attorneys' fees, costs associated with the lawsuit, and any further relief deemed appropriate by the court.
