Anthony LoBaido, a former contractor at Stanford Medicine, has filed a lawsuit against Aerotek for unpaid wages and unfulfilled promises of full-time employment. The complaint was filed in the Superior Court of California, County of Santa Clara on October 17, 2024. LoBaido alleges that Aerotek failed to compensate him for 290 extra hours worked and misled him about transitioning his role to full-time status.
LoBaido's journey with Aerotek began on August 10, 2023, when he was contacted by the company to consider a position at Stanford Medicine and Health Care. After a lengthy interview process lasting ten weeks, he was hired as a part-time Technical Trainer at $70 per hour. Despite assurances from Aerotek that his role would become full-time due to Stanford's interest in his AI project ideas, this transition never materialized. LoBaido claims he worked tirelessly between October 23, 2023, and January 29, 2024, accumulating an additional 290 hours beyond his contracted schedule.
In the lawsuit, LoBaido accuses Aerotek of breach of contract and failure to pay wages owed under California labor laws. He recounts numerous interactions with Jose De La O from Aerotek who assured him that the extra hours would be reconciled but later informed him no payment would be forthcoming. "It was Mr. De La O’s suggestion that I might have to think about legal recourse," LoBaido states in his declaration.
LoBaido also suffered a spinal injury while working as a scribe at Stanford Hospital on November 11, 2023. Despite receiving some support from Aerotek for chiropractic care, he bore most rehabilitation costs himself without any unemployment benefits or disability aid during recovery. He expressed disappointment over not receiving financial help during this challenging period.
The plaintiff is seeking judgment for unpaid wages totaling $20,300 and demands compensation equivalent to one year's salary amounting to $140,000 based on the promise of full-time employment made by Aerotek and Stanford Medicine's expressed interest in his projects.
