Former Employee Sues Sportplex Food & Beverage Over Wage Violations

A former employee has filed a lawsuit against her previous employers, alleging multiple violations of labor laws, including failure to pay wages and provide adequate breaks. The complaint was filed by Aidee Alvear on November 18, 2024, in the Superior Court of California, County of Santa Clara, against Sportplex Food & Beverage LLC and The Plex LLC.

Aidee Alvear accuses her former employers of failing to compensate for all hours worked, not paying minimum and overtime wages, and not providing accurate wage statements. She claims that these companies did not pay her and other employees for "off the clock" work due to a policy that rounded down hours worked. This resulted in what she describes as "time shaving," leading to unpaid wages. Alvear also alleges that Sportplex failed to provide proper rest and meal breaks as required by law. She argues that the company's culture and policies made it impossible for employees to take uninterrupted breaks due to understaffing and heavy workloads.

Alvear's complaint details how Sportplex allegedly violated various sections of the California Labor Code. For instance, she asserts that they failed to include bonuses in calculating overtime pay rates, violating Labor Code § 510. Additionally, she claims that Sportplex did not reimburse business expenses such as uniforms or personal cell phone use for work purposes, which is a violation under Labor Code § 2802.

The plaintiff seeks several forms of relief from the court. These include compensation for unpaid wages, penalties for labor code violations, reimbursement for business expenses, damages for unfair business practices under California Business and Professions Code Section 17200, and attorney's fees. Furthermore, Alvear is pursuing penalties under the Private Attorneys General Act (PAGA) on behalf of herself and other aggrieved employees.
