California Couple Alleges Major Auto Manufacturer Sold Defective Vehicle

A California couple has taken legal action against a major automobile manufacturer and dealership, alleging that their vehicle is riddled with defects and malfunctions. On December 16, 2024, Joshua Adam Ineichen and Krystle Elaine Ineichen filed a complaint in the Superior Court of California, County of Sacramento, against Ford Motor Company and Folsom Lake Ford, Inc.

The plaintiffs claim that after purchasing a 2018 Ford Expedition on January 9, 2021, they encountered numerous issues with the vehicle that significantly impaired its use, value, and safety. They allege violations of several laws including the Song-Beverly Consumer Warranty Act and the Federal Magnuson-Moss Warranty Act. According to the complaint, "Defendants violated the Song-Beverly Consumer Warranty Act by failing to conform the Vehicle to the express written warranties within a reasonable number of repair attempts or within the warranty periods." The plaintiffs assert that despite multiple repair attempts at authorized facilities, the vehicle's defects persisted.

Joshua and Krystle Ineichen accuse Ford Motor Company of being aware of these defects yet continuing to sell defective vehicles to consumers. They also allege that Folsom Lake Ford failed to properly diagnose and repair these issues. The complaint states that "Defendant intentionally failed to properly diagnose the issues in the Subject Vehicle" and accuses them of installing substandard components during repairs.

The lawsuit seeks various forms of relief from the court. The plaintiffs are asking for actual damages amounting to $72,096.72 along with consequential and incidental damages. They are also seeking restitution for all payments made towards the vehicle as well as civil penalties under the Song-Beverly Act amounting to twice their actual damages. Additionally, they request attorney’s fees, prejudgment interest, costs incurred during litigation, and injunctive relief to prevent further alleged unfair business practices by the defendants.
