Plaintiff Alleges Local Venue Negligence Following Violent Assault

A dramatic legal battle is unfolding in San Francisco as a plaintiff accuses a local entertainment venue and its affiliates of severe misconduct. The complaint, filed by Yosselin Coronado Garcia on December 16, 2024, in the Superior Court of California, County of San Francisco, names Roccapulco, Leticia M Luna as Trustee of Leticia M Luna Revocable Trust, RLL Entertainment LLC, Jane Doe, and additional unnamed defendants. The allegations include assault, battery, intentional infliction of emotional distress, negligence, and negligent hiring practices.

According to the complaint filed by Garcia's attorney Peter N. Hakim from Downtown L.A. Law Group, the incident occurred on January 21, 2023. Garcia claims she was at Roccapulco when she was unexpectedly approached by Jane Doe, identified as a security guard for the venue. As per Garcia's account in the court documents, Doe instructed her to leave the premises without any apparent reason. When Garcia questioned this directive, Doe allegedly assaulted her with such force that it resulted in physical injuries and emotional trauma.

Garcia asserts that this unprovoked attack left her with significant physical and psychological damage. She alleges that at no point did she provoke or attempt to retaliate against Doe during the encounter. In seeking justice through the court system, Garcia is pursuing general and special damages for her injuries and emotional distress as well as punitive damages aimed at deterring similar conduct in the future.

The lawsuit also highlights alleged failures on part of Roccapulco and its associated entities concerning their hiring practices. The complaint argues that these entities were negligent in hiring Jane Doe despite knowing—or having reason to know—of her incompetence or unfitness for her role as a security guard. This negligence allegedly contributed directly to the harm suffered by Garcia.

In addition to seeking compensatory damages for medical expenses and other costs incurred due to the incident, Garcia is asking for punitive damages under California Civil Code § 3294. This provision allows for such damages when a defendant's actions are found to be malicious or oppressive.
