Ray Montgomery has filed a lawsuit in the Superior Court of California, County of Santa Clara, on February 7, 2025, against Darcie Lynn Green and Latinas Contra Cancer. The case alleges that Green made false and defamatory statements about Montgomery, accusing him of criminal conduct such as physical assault and choking. These accusations have allegedly caused severe harm to Montgomery's personal reputation, professional standing, and emotional well-being.

According to the complaint, Montgomery claims that the defamatory statements were disseminated by Green with actual malice and reckless disregard for the truth. The statements were reportedly shared during private conversations with influential people and business professionals to harm Montgomery's reputation and interfere with his ability to earn a living. As a result of these actions, Montgomery has suffered irreparable damage to his reputation and personal relationships, leading to economic harm through the loss of professional opportunities and his forced resignation from his job.

Montgomery's complaint details several causes of action against Green and Latinas Contra Cancer. These include defamation at common law and pursuant to California Civil Code §46, intentional infliction of emotional distress, negligent infliction of emotional distress, negligent supervision and retention by Latinas Contra Cancer, false light invasion of privacy, and interference with prospective economic advantage. He is seeking compensatory damages for emotional, financial, and reputational injuries as well as punitive damages to punish Green’s malicious conduct. Additionally, he seeks injunctive relief to prevent further defamatory conduct by the defendants.

The complaint outlines how Montgomery's relationship with Green deteriorated in June 2024 after an incident at his residence where Green allegedly became confrontational upon seeing another guest present. Following this incident, it is alleged that Green began spreading false allegations about Montgomery's behavior during their personal encounter. Despite knowing these claims were false—supported by witness testimony—Green continued her campaign against Montgomery.

Montgomery also accuses Latinas Contra Cancer of failing to supervise Green adequately or control her use of organizational resources for spreading defamatory statements. He asserts that this negligence facilitated Green’s wrongful conduct within her role as Executive Director at the nonprofit organization.

The case seeks various forms of relief including general damages for harm caused; special damages covering lost wages due to premature retirement; punitive damages aimed at deterring similar future misconduct; prejudgment interest; attorneys’ fees; costs incurred during litigation; along with any other appropriate remedies deemed just by the court.
