SAN FRANCISCO – A San Francisco company alleges a law firm negligently misrepresented it in a legal matter.
Aevoe Corp., doing business as Moshi, filed a complaint on Dec. 6 in the San Francisco Superior Court against Polsinelli PC alleging legal malpractice, negligent misrepresentation and breach of fee limit agreement.
According to the complaint, in December 2016, the defendant began representing the plaintiff in a legal matter with Racing Optics. The suit states in March 2017, the defendant negotiated a settlement to resolve the matter but six months after the agreement was signed, an emergency motion and demand for arbitration was filed against the plaintiff by Racing Optics. The arbitrator ruled against the plaintiff in December 2017 and found "Polsinelli's claimed interpretation was not only incorrect, but that the ambiguity in the negotiated agreement with Racing Optics could easily have been eliminated or clarified with some minor language changes."
The plaintiff holds Polsinelli PC responsible because the defendant allegedly failed to adequately represent plaintiff in providing competent legal advice, full and accurate communications, accurate billing, and legal advice in accordance with relevant standards within the practice of law.
The plaintiff seeks judgment for general and special damages, costs of suit, interest and such further relief as the court may deem proper. It is represented by Thomas L. Gourde of Ray & Gourde LLP in Irvine.
