SAN FRANCISCO - A March 24 complaint filed in the San Francisco County Superior Court accuses a Portland, Ore.-based tea manufacturer of failing to disclose an alleged dangerously high level of lead in their tea and powder products.
The complaint from plaintiff Center for Environmental Health says that the tea and coffee wholesaler PDX Aromatics LLC is in violation of Proposition 65 by failing to fix a warning label to its kratom-containing products to inform consumers of a high lead level, which may cause birth defects, cancer or reproductive harm.
The Center for Environmental Health accuses PDX Aromatics of violating health and safety code, and requests the court assess civil penalties of $2,500 per day per violation of Proposition 65.
