Cathy Aguirre has filed a class action lawsuit against Trademark Staffing, Inc., alleging systematic wage and hour violations. The complaint was filed on March 13, 2025, in the Superior Court of California, County of Santa Clara. Aguirre claims that Trademark Staffing failed to comply with several labor laws, resulting in unfair competition.
The lawsuit alleges that Trademark Staffing violated multiple provisions of the California Labor Code and Industrial Welfare Commission Wage Orders. According to Aguirre, the company failed to pay minimum and overtime wages, did not provide lawful meal periods or rest breaks, neglected to reimburse business expenses, and issued inaccurate wage statements. Furthermore, Aguirre accuses the company of failing to pay all wages due upon employment separation. "Defendants have increased their profits by violating state wage and hour laws," Aguirre states in her complaint.
Aguirre seeks monetary relief for herself and others similarly situated in California. The relief sought includes unpaid wages, unreimbursed business expenses, benefits, interest, attorneys' fees, costs and expenses, and penalties under various sections of the Labor Code. Additionally, she demands injunctive relief to prevent further violations by Trademark Staffing.
