Plaintiff injured driver sues defendant motorist for negligence

A tragic car accident has led to a legal battle in Santa Clara County, California. The complaint was filed by Donald Polk on April 21, 2025, against Sivabalu Yesuvadiyan and unnamed defendants referred to as DOES 1 through 10. Polk is seeking justice for personal injuries sustained during the incident.

The lawsuit was filed in the Superior Court of California, County of Santa Clara. According to the complaint, the accident occurred on June 19, 2023, when Polk was driving westbound on Montague Expressway in San Jose. As he attempted to turn left onto Northbound Zanker Road, Yesuvadiyan allegedly ran a red light at the intersection and collided with Polk's vehicle. This collision resulted in significant injuries and damages to Polk.

Polk's legal team argues that Yesuvadiyan and the other defendants were negligent in their operation of the vehicle. They claim that these parties were either owners or operators of the vehicle involved in the crash and that they acted with consent from one another. Furthermore, it is alleged that some defendants were agents or employees acting within their professional scope at the time of the incident.

The complaint also accuses certain defendants of negligent hiring, training, and supervision of Yesuvadiyan and others involved. This alleged negligence contributed to the circumstances leading up to the accident. As a result of these actions, Polk suffered both economic and noneconomic damages. Economic damages include medical expenses, loss of income or earning capacity, property damage, and other related costs. Noneconomic damages encompass physical suffering, mental anguish, loss of enjoyment of life, inconvenience, anxiety, and emotional distress.

In seeking relief from the court, Polk requests compensation for noneconomic damages exceeding jurisdictional limits as well as reimbursement for all medical expenses incurred due to his injuries. He also seeks compensation for lost earnings along with prejudgment interest where applicable by law. Additionally, he asks for coverage of all legal costs associated with this suit.
